Investing With a Regulated Firm

What it Means for Your Wealth 

A regulated firm operates within defined standards covering governance, client communication and the conduct of authorised activities. Working with a regulated firm is fundamental to safeguarding your financial interests through a structure of accountability, transparency and independent supervision. 

In the Dubai International Financial Centre (DIFC), the Dubai Financial Services Authority (DFSA) provides that framework for authorised financial services firms. Its purpose is not to predict markets or remove investment risk. Markets remain uncertain, and investing always carries the possibility of losing capital. What regulation establishes is a clearer standard for how an authorised firm conducts its business and serves its clients. 

Does the conversation start with your circumstances? 

Before any strategy is considered, your objectives, circumstances, liquidity requirements and risk preferences should be understood. The investment then needs to be assessed in the context of your wider portfolio and the role it is intended to play. A strategy presented before those questions are asked is a product being placed rather than a portfolio being built. 

Who independently verifies what you are being told? 

One of the most important questions to ask before investing is a simple one: who independently verifies what I am being told? 

Independent custody, administration, valuation and audit, where applicable, create additional points of verification around the information you receive. Ask who holds the assets, who calculates their value, and who audits the result.  

What stands behind a guaranteed return? 

A promised return is only as strong as the party making the promise. A fixed coupon does not mean your capital is protected. If an issuer cannot meet its obligations, you are exposed to that issuer's credit risk. 

Before accepting a high or guaranteed return, ask the more fundamental question: what stands behind the guarantee? Understanding the issuer, the underlying obligation and the conditions attached to the promise is essential. 

What does your client classification mean in practice? 

In the DIFC, firms classify clients as Retail or Professional, and the classification carries real consequences. Professional Clients are assumed to have the experience and resources to evaluate investments for themselves, so some of the protections available to Retail Clients are applied differently or not at all. 

Being classified as a Professional Client is entirely ordinary for an experienced investor or family office. What matters is that you understand which protections apply to you, that the classification was explained rather than assumed, and that the firm can tell you how it reached that conclusion. 

Who manages the money, and what happens if they leave? 

Investment decisions are made by people, and in a boutique the number of those people is small. Ask who holds discretion over your portfolio, who reviews their decisions, and what happens if a key individual is unavailable. A systematic manager should be able to show you the process that would continue to operate in their absence, which is one of the practical arguments for a rules-based approach over a discretionary one. 

Where to Verify Independently 

Three checks cost very little time and are worth making before any capital moves. 

  • Confirm the firm and its permitted activities on the DFSA Public Register.

  • Ask the names of the custodian, administrator and auditor, then confirm them directly with those parties rather than through the firm. 

  • Read the client agreement and the fee schedule in full, including the sections dealing with valuation, redemption and conflicts of interest.
